Terms of Service — EstheticSense

These Terms of Service ("Terms") are an agreement between you and Zeurix, LLC, a Virginia limited liability company that operates EstheticSense ("EstheticSense", "we", "us"). They govern access to and use of EstheticSense websites and currently available software services (the "Service"). By using the Service, you agree to these Terms.

1. Eligibility and authority

You may use the Service only if you can form a binding contract and comply with applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts and security

You are responsible for maintaining accurate account information.
You must safeguard your credentials and authentication methods.
You are responsible for activity occurring under your account.

3. Acceptable use

You agree not to:

Access data or systems without authorization.
Interfere with Service operation, availability, or security.
Use the Service for unlawful, fraudulent, or abusive activity.
Attempt to reverse engineer or bypass platform controls.

4. Customer data

Customer organizations control their tenant data and are responsible for lawful collection and use of information they input into the Service. Our data handling practices are described in the Privacy Policy.

5. Third-party services

Some functionality may rely on third-party providers (for example, payment or messaging integrations). Third-party services are governed by their own terms and policies.

Our apps use Apple and Google services for distribution, notifications and in-app purchases, and Stripe for card payments and card readers, each under that provider's terms.

6. Service availability and changes

We may modify features, functionality, or interfaces. We do not guarantee uninterrupted operation.

7. Fees and billing

Paid plans, if applicable, are subject to the pricing and billing terms presented at purchase or renewal. Failure to pay applicable fees may result in suspension or limitation of access.

Subscriptions bought on the web

Web subscriptions are billed monthly through Stripe and renew automatically unless you cancel before the next renewal. The price is shown before you subscribe. Changes to your providers or locations apply at the next renewal, with no mid-month charges or proration. We give existing customers at least 60 days' notice before a price change.

The free trial lasts 7 days and requires no payment card. If you subscribe during the trial, your paid period starts when the trial would have ended. If you do not subscribe, the trial does not create an automatic charge: your workspace becomes read-only for 30 days, then your data is deleted with warnings.

You can cancel a web subscription through your billing settings. There is no cancellation fee, and access continues until the end of the paid period. The workspace then becomes read-only for 30 days before deletion with warnings. Cancellation stops future renewals; it does not itself issue a refund. To ask about a refund for a web purchase, contact support@estheticsense.io.

If a subscription payment fails, Stripe retries for 14 days with reminders while you can update your payment card. If payment is not recovered, the workspace becomes read-only for 30 days, then your data is deleted with warnings.

Prices are in USD and exclude tax. We collect applicable tax through Stripe Tax where we are registered to collect it. Your billing address is collected at checkout.

Subscriptions bought through the App Store or Google Play

If you subscribe through Apple's App Store or, once available, Google Play, the store bills you under its own terms. The subscription renews automatically at the end of each period unless you cancel it in your App Store or Google Play subscription settings at least 24 hours before the period ends; the store's price for your region and period is shown before you confirm. Refunds for store purchases are handled by the store under its policies. For the iOS app, Apple's standard licensed-application end-user licence agreement applies to your use of the app where these terms do not say otherwise.

8. Intellectual property

EstheticSense and its licensors retain all rights, title, and interest in the Service, including software, content, trademarks, and documentation. These Terms do not transfer ownership rights.

9. Suspension and termination

We may suspend or terminate access when necessary to protect the Service, comply with law, investigate misuse, or enforce these Terms. You may stop using the Service at any time.

10. Disclaimer

The Service is provided on an "as is" and "as available" basis to the extent permitted by law. We disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, EstheticSense is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenues, data, or goodwill.

12. Changes to these terms

We may update these Terms from time to time. Continued use of the Service after updates become effective means you accept the revised Terms.
